Draft Commission Regulation on recycled plastic materials and articles intended to come into contact with foods, and repealing Regulation (EC) No 282/2008:
The regulation concerns the placing on the market of plastic materials and articles with recycled/secondary plastic content intended for use in contact with food. It sets out rules for the manufacture thereof, suitable recycling technologies, recycling processes, recycling installations, plastic waste, collection and sorting of plastic input and the decontamination thereof, and the use of the plastic output, quality control, registration of business operators and enforcement, with the purpose to ensure that the recycled content in the final plastic materials and articles intended for contact with food do not cause harm to the consumers of those foods, or change their quality or organoleptic properties. The Regulation repeals Regulation (EC) No 282/2008, which it will replace. |

The Phytosanitary Conditions (Amendment) Regulations 2021:
This instrument amends the retained Commission Implementing Regulation (EU) 2019/2072 ("the Phytosanitary Conditions Regulation") pursuant to the European Union (Withdrawal) Act 2018 and European Union (Withdrawal Agreement Act 2020) . It will introduce measures in England, Scotland and Wales (Great Britain) for certain pests (Neocerambyx raddei and Agrilus bilineatus) against the import of host plants and other relevant regulated goods of Quercus, Castanea, and Castaniopsis from certain countries. Pest Risk Analyses (PRAs), conducted by the European and Mediterranean Plant Protection Organisation (EPPO), have recommended both pests for regulation and suggested the approach that Great Britain are introducing to tackle these risks to biosecurity. Based on these PRAs, these pests were added in January 2021 as provisional quarantine pests (PQPs) in GB legislation (The Plant Health (Phytosanitary Conditions) (Amendment) (EU Exit) Regulations 2020) (...) Further, a failure to implement the legislation as soon as possible extends the period that Great Britain is exposed to the serious biosecurity threat presented by these two pests as set out in the EPPO PRAs. This instrument amends the retained Commission Implementing Regulation (EU) 2019/2072 ("the Phytosanitary Conditions Regulation") pursuant to the European Union (Withdrawal) Act 2018 and European Union (Withdrawal Agreement Act 2020) . It will introduce measures in England, Scotland and Wales (Great Britain) against the import of host plants and other relevant regulated goods for certain pests (Prodiplosis longifila, Agrilus fleischeri, Thekopsora minima and Agrilus planipennis) . Imports of these high-risk plant goods will only be permitted under certain conditions e.g. the goods being grown in a pest free area, treated with heat. It will also introduce a prohibition on the import of Polymnia sonchifolia plants from entering Great Britain. Pest Risk Analyses (PRAs), conducted by the European and Mediterranean Plant Protection Organisation (EPPO), have recommended Prodiplosis longifila, Agrilus fleischeri, and Thekopsora minima for regulation and suggested the approach that Great Britain are introducing to tackle these risks to biosecurity. his instrument uses a power in the retained Regulation (EU) 2017/625 ("the Official Controls Regulation") to make regulations requiring the pre-notification of goods detailed in Article 73 ("Article 73 goods") of the retained Plant Health Regulation (Regulation (EU) 2016/2031), entering England, Scotland and Wales (Great Britain) . Such a requirement will apply to 1% of imports of Article 73 goods, selected for phytosanitary import checks, from all countries. Please see section 3 for a link to the list of Article 73 goods. This measure will provide information on the movement of these goods, which will allow for better targeting of inspections, to determine whether they present a biosecurity risk.
