National Emission Standards for Hazardous Air Pollutants: Plywood and Composite Wood Products: Proposed rule - The U.S. Environmental Protection Agency (EPA) is proposing amendments to the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Plywood and Composite Wood Products (PCWP), as required by the Clean Air Act (CAA) . To ensure that all emissions of hazardous air pollutants (HAP) from sources in the source category are regulated, the EPA is proposing HAP standards for processes currently unregulated for total HAP (including acetaldehyde, acrolein, formaldehyde, methanol, phenol, propionaldehyde), non-mercury (non-Hg) HAP metals, mercury (Hg), hydrogen chloride (HCl), polycyclic aromatic hydrocarbons (PAH), dioxin/furan (D/F), and methylene diphenyl diisocyanate (MDI) . The standards the EPA is proposing include emission limitations and work practices applicable for PCWP process units and lumber kilns located at facilities that are major sources of HAP emissions. This proposal responds to the 2007 partial remand and vacatur of portions of the 2004 PCWP NESHAP in which the EPA previously concluded maximum achievable control technology was represented by no control (i.e., no emissions reduction) . This proposal also responds to or requests comment on issues raised in a petition for reconsideration the EPA received regarding the technology review and other amendments to the PCWP NESHAP the EPA finalized on 13 August 2020.

Incorporation by Reference; North American Standard Out-of- Service Criteria; Hazardous Materials Safety Permits: Notice of proposed rulemaking - FMCSA proposes amendments to its Hazardous Materials Safety Permits (HMSPs) regulations to incorporate by reference the updated Commercial Vehicle Safety Alliance (CVSA) handbook containing inspection procedures and Out-of-Service Criteria (OOSC) for inspections of shipments of transuranic waste and highway route-controlled quantities (HRCQs) of radioactive material (RAM) . The OOSC provide enforcement personnel nationwide, including FMCSA's State partners, with uniform enforcement tolerances for inspections. Currently, the regulations reference the 1 April 2022, edition of the handbook. Through this notice, FMCSA proposes to incorporate by reference the 1 April 2023, edition.

Energy Conservation Program: Test Procedure for Dishwashers: Notice of proposed rulemaking and request for comment - In this notice of proposed rulemaking ("NOPR"), the U.S Department of Energy ("DOE'') proposes to add clarifying instructions regarding the detergent reporting requirements and an enforcement provision for dishwashers to specify the detergent and dosing method that DOE would use for any enforcement testing of dishwasher models certified in accordance with the currently applicable dishwasher test procedure prior to 17 July 2023 (i.e., the date by which the dishwasher test procedure as amended by a final rule published on 18 January 2023, (notified as G/TBT/N/USA/1817/Add.1 ) will be mandatory for product testing) . DOE is also proposing to add within the amended test procedure clarifying instructions regarding the allowable dosing options for each type of detergent. DOE is seeking comment from interested parties on this NOPR.

National Emission Standards for Hazardous Air Pollutants: Coal- and Oil-Fired Electric Utility Steam Generating Units--Revocation of the 2020 Reconsideration, and Affirmation of the Appropriate and Necessary Supplemental Finding

Renewable Fuel Standard (RFS) Program: Standards for 2023-2025 and Other Changes: Proposed rule - Under the Clean Air Act, the Environmental Protection Agency (EPA) is required to determine the applicable volume requirements for the Renewable Fuel Standard (RFS) for years after those specified in the statute. This action proposes the applicable volumes and percentage standards for 2023 through 2025 for cellulosic biofuel, biomass-based diesel, advanced biofuel, and total renewable fuel. This action also proposes the second supplemental standard addressing the remand of the 2016 standard-setting rulemaking. Finally, this action proposes several regulatory changes to the RFS program including regulations governing the generation of qualifying renewable electricity and other modifications intended to improve the program's implementation.

Safer Products Restrictions and Reporting: Proposed rule - The Washington Department of Ecology proposes a new rule, Chapter 173-337 WAC – Safer Products Restrictions and Reporting; Washington Administrative Code (WAC) . This new chapter aims to reduce toxic chemicals in consumer products and implements Chapter 70A.350 RCW; Revised Code of Washington (RCW) . Ecology started the second phase of this rulemaking which opens the formal public comment period. This rulemaking proposes to: Implement regulatory actions reported to the Washington State Legislature in June 2022. Review the Final Regulatory Determinations Report; Create reporting requirements or restrictions that apply to priority consumer products that contain priority chemicals. These include: ◦ PFAS in aftermarket stain- and water-resistance treatments, carpets and rugs, and leather and textile furnishings. ◦ Ortho-phthalates in personal care products (fragrances) and vinyl flooring. ◦ Organohalogen flame retardants in electric and electronic products. ◦ Flame retardants (as defined in RCW 70A.350.010) in recreational polyurethane foam. ◦ Phenolic compounds in laundry detergent, food and drink can linings, and thermal paper. ◦ Include provisions for repair and replacement parts, refurbished products, and previously owned products.

Energy Conservation Program: Energy Conservation Standards for General Service Lamps: Notice of proposed rulemaking and announcement of public meeting on Wednesday, 1 February 2023 - The Energy Policy and Conservation Act, as amended ("EPCA"), directs the U.S. Department of Energy (DOE) to initiate two rulemaking cycles for general service lamps (GSLs) that, among other requirements, determine whether standards in effect for GSLs should be amended. EPCA also requires DOE to periodically determine whether more-stringent, standards would be technologically feasible and economically justified, and would result in significant energy savings. In this notice of proposed rulemaking (NOPR), DOE proposes amended standards for GSLs pursuant to its statutory authority in EPCA, and also announces a webinar to receive comments on its proposal and associated analyses and results.

Per- and Poly-Fluoroalkyl Chemical Substances Designated as Inactive on the TSCA Inventory; Significant New Use Rule: Proposed rule - Under the Toxic Substances Control Act (TSCA), EPA is proposing a significant new use rule (SNUR) for those per- and poly-fluoroalkyl substances (PFAS) that have not been manufactured (including imported) or processed for many years and are consequently designated as inactive on the TSCA Chemical Substance Inventory. PFAS are a group of chemicals that have been used in industry and consumer products since the 1940s because of their useful properties, such as water and stain resistance. Many PFAS break down very slowly and can build up in people, animals, and the environment over time. Exposure at certain levels to specific PFAS can adversely impact human health and other living things. Persons subject to the SNUR would be required to notify EPA at least 90 days before commencing any manufacture (including import) or processing of the chemical substance for a significant new use. Once EPA receives a notification, EPA must review and make an affirmative determination on the notification, and take such action as is required by any such determination before the manufacture (including import) or processing for the significant new use can commence. Such a review will assess whether the use may present unreasonable risk to health or the environment and ensure that EPA can prevent future unsafe environmental releases of the PFAS subject to this SNUR.

Energy Conservation Program: Energy Conservation Standards for External Power Supplies: Notice of proposed rulemaking and announcement of public meeting via webinar on Wednesday, 1 March 2023 - The Energy Policy and Conservation Act, as amended ("EPCA"), prescribes energy conservation standards for various consumer products and certain commercial and industrial equipment, including external power supplies ("EPSs"). EPCA also requires the U.S. Department of Energy ("DOE") to periodically determine whether more-stringent, standards would be technologically feasible and economically justified, and would result in significant energy savings. In this notice of proposed rulemaking ("NOPR"), DOE proposes amended energy conservation standards for EPSs, and also announces a public meeting to receive comment on these proposed standards and associated analyses and results.

Renewable Energy Modernization Rule: Notice of proposed rulemaking - The first Outer Continental Shelf (OCS) renewable energy regulations were promulgated in 2009 by BOEM's predecessor, the Minerals Management Service (MMS) . BOEM's renewable energy program has matured over the past 13 years, during which time BOEM conducted eleven auctions and issued and managed 27 active commercial leases. Based on this experience, the Department has identified opportunities to modernize its regulations to facilitate the development of offshore wind energy resources to meet U.S. climate and renewable energy objectives. This proposed rule contains reforms identified by the Department and recommended by industry since 2010, including proposals for incremental funding of decommissioning accounts; more flexible geophysical and geotechnical survey submission requirements; streamlined approval of meteorological (met) buoys; revised project verification procedures; reform of BOEM's renewable energy auction process; and greater clarity regarding safety requirements. This proposed rule would advance the Department of the Interior's (DOI) energy policies in a safe and environmentally sound manner that would provide a fair return to the U.S. taxpayer.
