REGULATIONS IMPLEMENTING THE INWARD PROCESSING REGIME

Chapter VIII - Destruction and Donation of Goods Entering under the Regime

Article 31.- Containers, packaging and wrapping.
At any time, Regime beneficiaries may freely dispose of containers, packaging and wrapping used in transporting goods purchased under the Regime. (...)

Likewise, when such goods are donated, destroyed or recycled, Regime beneficiaries shall record such operations in their records in such a way that the customs authority may at any time verify their destination without the need to be present when the goods are donated, destroyed or recycled.

Article 32.- Wastage, residue and waste.
At any time, Regime beneficiaries may freely enter for home use, re-export, destroy, donate, recycle or dispose of the residue and waste resulting from their production process.

For these purposes, they need only submit to PROCOMER, together with the annual operating report, a breakdown containing the description of the goods and the percentage and use accorded to them, so that PROCOMER may carry out a documentary check of the information, in accordance with the percentages of wastage, residue or waste approved.

In the exercise of its powers, the Directorate may carry out periodic audits, for which purpose it may request the reports submitted to PROCOMER by the beneficiary enterprises.

Article 34.- Waste of goods subject to special regulations.
In the case of goods inward cleared under the Regime which require special processes for their destruction, for turning them into waste or recycling them because of environmental risks, the beneficiary shall employ a technically capable firm for this operation, if it does not have the proper resources or methods to dispose of such materials.

Notification to the customs authority and its participation shall comply with the procedures prescribed by the Directorate for this purpose.

Article 35.- Donations of goods.
Beneficiaries may donate semi-manufactured goods, residue, waste, seconds through the Directorate-General for the Administration of Property and Administrative Contracting of the Ministry of Finance, in accordance with the terms laid down in the Regulations for the Registration and Supervision of Central Administration Property. This notification explains the amendments to the Inward Processing Regime in effect as of 20 February 2017. On this date, Executive Decree No. 40198 of 13 December 2016 came into effect, amending the Inward Processing Regime in order to comply with the provisions in the Agreement on Subsidies and Countervailing Measures (SCM Agreement) of the World Trade Organization (WTO).
