3. Ozone-depleting substances – ODS - (controlled substances): The import of ozone-depleting substances (ODS) is subject to licensing. In the context of the Vienna Convention for the Protection of the Ozone Layer and the Montreal Protocol on the substances that deplete the ozone layer, the European Commission issues ODS licences based on applications submitted via the ODS Licensing System. Imports (as well as exports) of controlled substances, referred to hereby as ozone depleting substances (ODS) and products and equipment containing or relying on ODS are prohibited. However, there are exemptions to this prohibition.

Reduction of risks relating to the use of certain particularly dangerous substances, preparations and articles (mercury): In order to implement the Minamata Convention on Mercury, ratified by Switzerland on 25 May 2017, which seeks to establish measures aimed at regulating the supply and demand of mercury at international level, the legislation on chemical products was amended so as to introduce a control system for imports of mercury, mercury compounds and mercury alloys. These products can only be imported after import authorization has been issued. Certain exceptions to this rule may, however, apply where the products concerned are imported for research and development purposes.

Elemental mercury: The importation of elemental mercury as per the definition under Subregulation 2(1) of the Customs (Prohibited Imports) Regulations 1956, is prohibited under Regulation 4AC of the Customs (Prohibited Imports) Regulations 1956 unless permission has been granted. Import of mercury is also prohibited without approval under the following legislation. Permission to import mercury may be granted under the relevant legislation by the relevant Minister or authorised officer, if it meets the requirements under Article 3 of the Minamata Convention on Mercury.

21. Ozone-depleting substances and synthetic greenhouse gases:Australia manages its obligations under the Montreal Protocol on Substances that Deplete the Ozone Layer for ozone depleting substances and hydrofluorocarbons (HFCs) and, for synthetic greenhouse gases other than HFCs, the United Nations Framework Convention on Climate Change (UNFCCC), through the Ozone Protection and Synthetic Greenhouse Gas Management Act 1989. The import, export and manufacture of the ozone depleting substances - chlorofluorocarbons, halons, carbon tetrachloride, methyl chloroform, bromochloromethane and methyl bromide (for non quarantine and pre-shipment use) is prohibited under the Montreal Protocol except where an essential or critical use exemption has been granted by the parties to the Montreal Protocol. The phase out of ozone depleting hydrochlorofluorocarbons (HCFCs) under the Montreal Protocol is almost complete. Control measures for HFCs under the Kigali Agreement to the Montreal Protocol commenced on 1 January 2019 to phase-down the production and import of HFCs.
Australia's Montreal Protocol obligations are implemented through licensing controls and quota restrictions on HCFCs and HFCs, and licensing of imports of methyl bromide. A licence is required to import equipment containing HFCs. The import of equipment containing HCFCs is prohibited except in certain limited circumstances when an import licence may be granted. |

The Resolution of the Cabinet of Ministers of Ukraine "On Approving the List of goods export and import of which is subject to licensing and quotas for 2022" No. 1424 of 29 December 2021: The Resolution of the Cabinet of Ministers of Ukraine "On Approving the List of goods export and import of which is subject to licensing and quotas for 2022" No 1424 of 29 December 2021 approves the list of goods that are subject to import licensing in 2022. The Resolution specifies goods falling under the system of non-automatic licensing and administrative bodies responsible for issuing of approvals to obtain a license for importation of particular categories of goods under this system of licensing. The Regulation specifies namely:
— list of controlled substances ( ozone -depleting substances and fluorinated greenhouse gases), import of which is subject to licensing, — list of goods and equipment that may contain controlled substances ( ozone -depleting substances and fluorinated greenhouse gases, the import of which is subject to licensing (except for goods and equipment transported in containers with personal belongings)), — list of goods, imported from Republic of North Macedonia, subject to licensing within the tariff quota established pursuant to the Free Trade Agreement between Ukraine and Republic of Macedonia of 18 January 2001, such as lamb, dried vegetables, confectionery, chocolate, etc. Ministry of Economy of Ukraine considers licenses applications and its issues. The Ministry obtains prior approval of importation of controlled substances as well as goods and equipment that can contain controlled substances (ozone -depleting substances and fluorinated greenhouse gases) from the Ministry for Protection of Environment and Natural Resources in the order of interagency exchange of information. |

Chief Executive's Decision No. 45/2022: In order to implement the Kigali Amendment to the Montreal Protocol on Substances that Deplete the Ozone Layer, the Macao Special Administrative Region (SAR) Government has included 18 kinds of hydrofluorocarbons (HFCs) with high global warming potential (GWP) into the regulatory scope of Decree-Law No. 62/95/M through Chief Executive's Decision No. 45/2022, that is, HFCs and equipment containing HFCs will be included in the licensing regime. The relevant measures will enter into force on 1 April 2022, and the import or export of the goods concerned shall be subject to licensing requirements.
