Addition of Certain Chemicals; Community Right-to-Know Toxic Chemical Release Reporting: In response to a petition filed under the Emergency Planning and Community Right-to-Know Act (EPCRA), EPA is proposing to add 12 chemicals to the list of toxic chemicals subject to the reporting requirements under EPCRA and the Pollution Prevention Act (PPA) . EPA believes that each of the 12 chemicals meets the EPCRA criteria. In addition, based on the available bioaccumulation and persistence data, EPA believes that one chemical should be classified as a persistent, bioaccumulative, and toxic (PBT) chemical and designated as a chemical of special concern with a 100-pound reporting threshold.

Specifically, EPA is proposing to extend the compliance date applicable to the processing and distribution in commerce of certain PIP (3:1)-containing articles, and the PIP (3:1) used to make those articles until 31 October 2024, along with the associated recordkeeping requirements for manufacturers, processors, and distributors of PIP (3:1)-containing articles. EPA is also announcing its intention to commence a new rulemaking effort on PIP (3:1) and four other persistent, bioaccumulative, and toxic (PBT) chemicals that have been regulated under TSCA section 6(h) . EPA is anticipating issuing a proposal to this end in 2023.

Those reporting requirements were set forth in a final rule entitled "Reporting Requirements for TSCA Mercury Inventory: Mercury" (hereafter "mercury inventory reporting rule") . These revisions implement an order issued by the United States Court of Appeals for the Second Circuit (Second Circuit), on 5 June 2020.
