1.2 The National Centre for Biological Safety (CNSB), as the regulatory centre of the Ministry of Science, Technology and the Environment (CITMA), is responsible for, inter alia, granting licences for the use, testing, production, release, importation and exportation of, and research into, biological agents and their products, and organisms and parts thereof containing genetic information, in the national territory, and at the various stages of the construction of facilities posing a biological risk. This procedure is in conformity with the Cartagena Protocol on Biosafety to the Convention on Biological Diversity and the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction.

Import licences issued by the Agriculture, Fisheries and Conservation Department are required for the import of animals and plants listed in CITES Appendix I (including their parts and derivatives, and things claimed to contain ingredients made from these endangered species), and live endangered species of wild origin in CITES Appendix II. Import licences are not required for the import of CITES Appendix II species other than live specimens of wild origin and CITES Appendix III species, subject to the production of a valid CITES export permit or certificate of origin.

6.1. T he import of waste into HKSAR is controlled under a permit system administered by the Environmental Protection Department. Its requirements are tied in with those of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal. A permit is required for import of any waste, unless the waste is specified in Schedule 6 of the Waste Disposal Ordinance (Cap. 354) and it is uncontaminated and is intended for recycling or re-use purposes.

3.3. This licensing system covers all specimens listed in Appendices I, II and III of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). For imports of animals and plants specified in the CITES Appendices I, II and III, CITES certificates or relevant export licenses issued by exporting countries or territories are required. On the other hand, for specimens of species listed in CITES Appendix III imported directly from countries other than the listing countries, certificates of origin issued by exporting countries or territories could be accepted in lieu.

3.2. Mauritius together with Madagascar and Indian Ocean Islands has been designated by IUCN as biodiversity hotspot. The majority of endemic Mauritian flora and fauna are considered threatened and with some 60 species of native plants believed to be already extinct. As a consequence, Legislation and regulations have been enacted to control and monitor the entry of exotic wildlife. Mauritius being party and compliant to the Convention on International Trade in Endangered Species of flora and Fauna (CITES) also regulates trade with respect to CITES listed species. The National Parks and Conservation Service is responsible for regulating both importation of exotic wildlife and CITES listed (prescribed) species through provisions of the Native Terrestrial Biodiversity and National Parks Act 2015.
Section 10(1) and (2) of the wildlife regulations (1998) allows the authorised officer to refuse an application for a permit. In general the following are reasons for refusal of an import permit: invasive species, no adequate facility at importer’s premises and veterinary objection due to threat of diseases. |
