4.33. With support from the European Commission, in February 2010 Chad launched the Gum Arabic Sector Support Programme (PAFGA). Planned to last three years, the PAFGA aims to organize the sector more effectively, enhance the quality of the gum produced, and increase production, while ensuring sustainable resource use.

4.35. The conservation and management of fish and aquaculture resources are governed by Law No. 014/PR/2008 of 10 June 2008 establishing the forestry, fauna and fisheries regime. Under this law, the exercise of fishing activities requires a fishing permit, for which there are two categories: category A, reserved for nationals, and category B for foreigners. The fishing permit is valid for a renewable one year period and is issued following payment of a fee set at CFAF 12,500 for nationals, and CFAF 75,000 for foreigners.

4.37. The Fisheries Development Project (PRODEPÊCHE) is a tool of government policy in this sector. Launched in 2006, it aims to sustainably improve living standards for participants through capacity building, development and rational management of fish resources, and marketing support.

4.39. The forestry management and conservation regime is contained in Law No. 014/PR/08 of 10 June 2008 establishing the forestry, fauna and fisheries regime. This Law supplements Law No. 14/PR/98 of 17 August 1998 defining general principles of environmental protection. The goal of government policy is to make use of these resources for development and poverty reduction, while conserving their biological diversity.

4.34. In order to revive the sector the Congo has adopted several regulatory texts on sustainable fishing, and those most worthy of note are as follows: Decree No. 2009-33 of 6 February 2009 laying down provisions on the mesh sizes of nets and maritime fishing gear; Decree No. 2011 317 of 26 April 2011 laying down the conditions for the pursuit of professional small scale marine fishing; Decree No. 2011 319 of 26 April 2011 establishing the procedures for the conduct of technical visits to fishing vessels in waters under Congolese jurisdiction, and Decree No. 2012 174 of 12 March 2012 on the status of observer on board a fishing vessel.

4.39. Under the National Forestry Action Plan (PAFN) adopted in 1994, the main regulatory instrument in this subsector is the Forestry Code enacted in 2000. Some of the innovations introduced by the Code include the requirement that 85% of logs should be processed on the spot ; in practice, processing mainly takes the form of sawing and has not reached the 85% target, with the shortfall being the subject of a surcharge (section 3.1). According to the International Tropical Timber Organization (ITTO), this regulatory framework provides the basis for sustainable forestry management and is being implemented in the Congo, apparently making the country one of the first countries in the world to do so. The forests in the Congo Basin are covered by the Treaty on the Conservation and Sustainable Management of Forest Ecosystems in Central Africa.

4.4. The Ministry responsible for agriculture is responsible for the formulation and implementation of agricultural policy. However, in line with the composition of the Government of 15 September 2009, as reshuffled on 25 September 2012, a number of other departments also have a role in agriculture, namely the Ministry of Forestry Economics and Sustainable Development, the Ministry of Fisheries and Aquaculture, and certain services attached to the Office of the President are responsible for steering the agricultural sector (General Major Public Works Delegation), each in its own specific area.

4.38. The 2001 Forestry Code is the main instrument for the regulation of forestry in Gabon. It is implemented by the Ministry responsible for forests. The Code establishes as its objective the sustainable management of water resources and forests, fauna and flora; Gabon is a party to the Treaty on the Conservation and Sustainable Management of Forest Ecosystems in Central Africa.

4.39. Under the Forestry Code, there are three types of industrial logging permit, two of which are strictly reserved for Gabonese nationals. These are: the mutual agreement permit (PGG), with an annual logging limit of 50 trees, and the associated forestry permit (PFA), which covers a maximum area of 15,000 hectares. The third type of permit, the sustainable forest concession (CFAD), is a concession granted for large areas of forest (50,000 to 200,000 hectares), generally logged by foreign enterprises. The CFAD involves obligations in respect of forest management and local processing.
