Decree establishing the rate of incorporation of recycled plastic in beverage bottles: The notified Decree defines the conditions for the application of certain provisions laid down in the Law of 10 February 2020 relating to the fight against waste and the circular economy, in particular those referred to in Article 61 of that Law, which establishes that the marketing of certain categories of products and materials may be subject to compliance with a minimum rate of incorporation of recycled material in these products and materials, and that these categories, rates, the method used for their calculation, and control procedures are specified by decree.

The notified Decree is issued under Article L. 541-9 (II) of the Environmental Code, introduced by Article 61 of the Law of 10 February 2020 relating to the fight against waste and the circular economy, which establishes that the marketing of certain categories of products and materials may be subject to compliance with a minimum rate of incorporation of recycled material in these products and materials, and that these categories, rates, the method used for their calculation, and control procedures are specified by decree.

The notified Decree establishes the mandatory incorporation of recycled material in beverage bottles in accordance with Directive No. 2019/904 of 5 June 2019 on the reduction of the impact of certain plastic products on the environment (Article 6) .

The notified Decree transposes the minimum incorporation rates of recycled plastic in beverage bottles and the deadlines provided for by aforementioned Directive, namely:
- a minimum of 25% in 2025 for PET-type plastic bottles;
- a minimum of 30% for all plastic bottles as from 2030. (...)

Decree concerning the mandatory display for sale of unprocessed fresh fruit and vegetables without packaging made entirely or partly of plastic: The Law of 10 February 2020 relating to the fight against waste and the circular economy establishes that retail stores displaying unprocessed fresh fruit and vegetables for sale will be required, as from 1 January 2022, to display such products for sale without plastic packaging (Article 77 of the Law) . The regulatory provisions specify the conditions for the application of provisions introduced by the Law of 10 February 2020 relating to the fight against waste and the circular economy. The provisions regulate the display for sale of unprocessed fresh fruit and vegetables for the final consumer. They apply only to the display for sale of these products and not to the stages preceding the display for sale, that is, production, packing and transportation. Retail stores will be required to offer unprocessed fruit and vegetables without plastic packaging on their shelves, with the exception of those that are likely to deteriorate when sold loose, and those packed in batches exceeding 1.5kg

his measure is designed in reference to other WTO member's rules, such as the EU's, to prevent and reduce the impact on the environment, in particular the aquatic environment, and human health. Tackling the negative impact that plastic waste has on our communities, oceans, rivers and land ecosystems has never been more important. Failing to act to protect our finite natural resources and to address the significant economic, social and environmental challenges associated with plastic litter is simply not an option. We must act to address the linear consumption model for single-use plastic items which remains far too prevalent. Our current throwaway culture causes pollution of our ecosystems, biodiversity loss, increased carbon emissions and litter. By introducing market restrictions, the Scottish Government wishes to see innovative solutions towards more sustainable business models and re-use alternatives prioritised over substitution of materials. These regulations represent an important next step in our efforts to tackle our plastic problem, allowing us to maintain pace with leading environmental regulatory standards while re-affirming Scotland's position as a world-leader in the circular economy

This draft amendment adds to the Order's First Annex a requirement that any import of plastic waste, classified as HS 39.15, shall require an import license from the Industries Administration at the Ministry of Economy and Industry. Approval will be granted in accordance with the standards and processes outlined in the Basel Convention.

In 1989, the State of Israel signed the Basel Convention, which regulates and controls transboundary movements of hazardous wastes and their disposal. In 2019 the Basel Convention had added a few new requirements applying to mixed plastic waste and required monitoring the import and export of these wastes. These requirements had entered into force on January 1, 2021. Israel's amendment is aligned with the new requirements.
