Ministry of Public Health has proposed to withdraw 5 needless Ministerial notifications as following;

• Notification of the Ministry of Public Health concerning of exemption of product registration and notification of product used in household or in public health for the purpose of removing or correcting words B.E. 2541 (1998)

• Notification of the Ministry of Public Health regarding the operation of hazardous substances of type 4, which the Food and Drug Administration has the authority and responsibility (No.2) B.E. 2543 (2000)

• Notification of the Ministry of Public Health regarding the operation of hazardous substances of type 4, which the Food and Drug Administration has the authority and responsibility (No.3) B.E. 2545 (2002)

• Notification of the Ministry of Public Health regarding the operation of hazardous substances of type 4, which the Food and Drug Administration has the authority and responsibility (No.4) B.E. 2547 (2004)

• Notification of the Ministry of Public Health: Exemptions of Obligations under the Hazardous Substance Act B.E. 2535 (1992) under responsibility of Thai Food and Drug Administration (No.4) B.E. 2545 (2002)

As a result, manufacturing of household cleaners containing NPE must comply with the Ministerial Regulation B.E. 2537 (1994), issued pursuant to the Hazardous Substance Act B.E. 2535 (1992) .

Measure description Coverage of the measure
Ministry of Public Health has proposed to withdraw 5 needless Ministerial notifications as following;

The draft notification aims at amending the list of Hazardous Substances (under the Hazardous Substances Act) . This proposed list involves the revision and inclusion of the respected hazardous substances attached to the Notification of Ministry of Industry on List of Hazardous Substances B.E. 2556 (2013) and the List of Hazardous Substances (No.4) B.E. 2560 (2017) .
Environment related objective
To amend the List of Hazardous Substances by revising its type and adding the new entry substances, the amendment will facilitate the proper measure on new concern substance control and it is also in line with the concern chemicals under Stockholm Convention on Persistent Organic Pollutants. It provides safety and benefit to human and environment.

The draft notification aims at amending the list of Hazardous Substances (under the Hazardous Substances Act) . This proposed list involves the revision and inclusion of the respected hazardous substances attached to the Notification of Ministry of Industry on List of Hazardous Substances B.E. 2556 (2013) and the List of Hazardous Substances (No.4) B.E. 2560 (2017) .

The updating law stipulated major amendments as the following:

• To state the definition for "Transit" of hazardous substances as to reflect the genuine manner of its activity which is clearly separate from the "Import". This aspect facilitates lower burden and speeds up the customs process for hazardous substances entrepreneurs whereby it reduces the bureaucratic steps from the original processing. The new rules have been established for more appropriate regulation, for instance, as the following:

- Requirements for damage insurance.

- Identifying the specific customs border for "transit" of hazardous substances.

- Upon the completion of all "transit" activities, the respected commodity shall be exported within 5 days from its release by the import customs check point.

- The "transit" licensee shall be a legally registered hazardous substances importer-exporter under the Kingdom of Thailand's legislation.

- Determining the "transit" license fee.

• To impose a waiver for substances that are necessary to be brought back or returned, in order to reduce the excessive duty from repeating the same procedure, provided that the responsible authority provisions and conditions are flowed.

• To establish provisions aimed at exemption for unitizations of hazardous substances under the purposes of study, analysis, research and development. This prosperous rule will reduce undue burden and introduce more efficient in practice.

• With respect to the regulation of hazardous substances advertisement, the related provision has been stipulated enabling full supervision by its own authority. The section shall comprehensively invalidate the previous implementation under the consumer protection legislation.

• To stipulate provisions in accordance to the payment of preliminary damage: it compensates those who have been adversely affected by hazardous substances including the responding agency. In case the commodity has been insured, the compensation shall be paid beforehand without liability approval.

• Additional provisions: The responsible agency shall demand the importer or "transit" operator, that violates or does not comply with the law, to urgently deliver of hazardous substances outside the Kingdom of Thailand and once determine that such hazardous substances shall not be destroyed or manipulated in the Kingdom of Thailand, the responsible agency shall collect hazardous substances sample(s) as necessary evidence for the proceedings.
Environment related objective
As a result of long placed existing legislation for control hazardous substances, the provisions shall be amended as to keep it updating / modernizing for prevailing emerging issues and enhancing more effective implementation. In the view of providing more feasible, effective and convenient operation for related stakeholders and also introducing advertising supervision control. The provisions promotes more safety and beneficial to human and environment.

The Ministry of Industry has proposed to withdraw the list of hazardous substances under the hazardous substances list attached to the Ministry of Industry Notification; Re. List of Hazardous Substances B.E. 2556 (2013) dated 28 August B.E. 2556 (2013), List 1.1, under the responsibility of Department of Agriculture. Manufacturers, importers, exporters, or any person having in possession of type 4 hazardous substances (prohibited pesticides) as listed in this notification prior to the effective date shall abide by the order of authorized officials within 30 days of the effective date.

This notification will be published in the Royal Gazette and will be in effect on 1 December 2019

List of Hazardous Substances B.E. 2556 (2013) dated 28 August B.E. 2556 (2013), List 1.1, under the responsibility of Department of Agriculture. Manufacturers, importers, exporters, or any person having in possession of type 4 hazardous substances (prohibited pesticides) as listed in this notification prior to the effective date shall abide by the order of authorized officials within 30 days of the effective date.

This notification will be published in the Royal Gazette and will be in effect on 1 December 2019

1) to resilience building for marine shrimp farmers' institutes and community enterprises to become self – reliance and self-sufficiency; have more bargaining power and can manage the marketing process and product distribution for domestic shrimp market.
2) to support small - scale marine shrimp farmers who are a member of farmer's institutes and community enterprises back in business by providing access to business opportunity and funding and specific pathogen-free shrimp seed.
Measure description Coverage of the measure
Capacity building on marine shrimp production and marketing for domestic shrimp consumption.
1) DOF provides grants for marine shrimp farmers at 90% of the prices to buy specific pathogen-free and quality shrimp seed. However, the grant should not be more than 40,000 Baht per each farmer.
2) BAAC provides soft loans for marine shrimp farmers to buy farming inputs. The loan amount for each farmer should not be more than 300,000 Baht in 1st year (2019). DOF will compensate farmers at 3% interest rate per year.
3) BAAC provides soft loans for marine shrimp farmer's institutes and community enterprises to increase managing and marketing abilities and product distribution. The loan amount for each farmer's institute/community enterprise should not be more than 2,000,000 Baht per each institute in 1st year (2019). DOF will compensate the farmers at 3% interest rate per year.

Farmers who follow the diversion programme from rice production to the production of diversion crops and adhere to any of the following cases:(a) Growing rice in the base year (1994-2003); or,(b) Growing guaranteed price purchase crops of feed corn, sorghum or sugarcane in the base year; or,(c) Registering as set-aside or diversion under "Rice Production and Rice Field Diversion Projects" in the base year.Diversified crops are selected according to policy objective and domestic conditions for such crops as feed corn, soybean, forage crops, wheat, sugarcane and other specialty local crops.
