This draft Commission Implementing Regulation provides that the approval of the active substance thiacloprid is not renewed in accordance with Regulation (EC) No 1107/2009. EU Member States shall withdraw authorisations for plant protection products containing thiacloprid as active substance. The non-renewal of the approval is based on the first evaluation of the substance for use as a pesticide active substance in the EU under Regulation (EC) No 1107/2009. The substance was formerly assessed and approved under Directive 91/414/ EEC.

This decision only concerns the placing on the market of this substance and plant protection products containing it. Following non-renewal of approval and the expiry of all grace periods for stocks of products containing this substance, separate action will likely be taken on MRLs and a separate notification will be made in accordance with SPS procedures.

This draft Regulation relates to an update of Annex II to Regulation (EC) No 1907/2006 (REACH) on requirements for safety data sheets (SDS):

• Alignment with the Globally Harmonized System of Classification and Labelling of Chemicals (GHS), 6th and 7th revisions, most prominently in Sections 9 (Physical and chemical properties) and 14 (Transport) .

• Alignment with the provisions of Annex VIII (on emergency health response) to Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures (CLP), in particular in relation to the Unique Formula Identifiers (UFIs) assigned to hazardous mixtures, in Section 1 (Identification) .

• Alignment with the new provisions for nanoform substances, adopted on 3 December 2018 through the revision of REACH Annexes I, III, and VI-XII to REACH (Commission Regulation (EU) 2018/1881), in Sections 1 (Identification), 3 (Composition/information on ingredients) and 9 (Physical and chemical properties) .

In addition to the above three main changes, a number of smaller amendments are proposed to the text, related to recent developments in the Commission's approaches to risk management of chemicals, such as on endocrine disruptors.

Application of the amended Annex is deferred to 31 December 2022 to allow stakeholders sufficient time to adapt and achieve compliance.

The enclosed draft implementing act and annexes contain the initiatives to lay down the administrative requirements for certificate templates, information documents, numbering systems, test result sheets and the format of test reports necessary for granting EU and national type approvals under the framework Regulation (EU) 2018/858.

These amendments secure that the type-approval authorities use harmonised templates, markings and presentation of the most relevant test information when granting type-approvals under EU Regulation 2018/858.
Environment related objective
Regulation (EU) No 2018/858 sets out general requirements on the approval and market surveillance of motor vehicles and their trailers (M-, N- and O-category vehicles) and of systems, components and separate technical units intended for such vehicles, amending Regulations (EC) No 715/2007 and (EC) No 595/2009 and repealing Directive 2007/46/EC.

Based on the empowerments in Regulation (EU) 2018/858, the Commission laid down in detail the administrative provisions and templates for the type-approval and market surveillance of M-, N- and O-category vehicles.

Regulation (EU) 2018/858 was published in the EU OJ in June 2018. The administrative requirements for certificate templates, information documents, numbering systems, test result sheets and the format of test reports were not included in the final adopted version of the framework Regulation (EU) 2018/858.

This implementing act of administrative nature is necessary for the regular implementation of Regulation (EU) 2018/858 already well known by the Member States and manufacturers.

The enclosed draft implementing act and annexes contain the initiatives to lay down the administrative requirements for certificate templates, information documents, numbering systems, test result sheets and the format of test reports necessary for granting EU and national type approvals under the framework Regulation (EU) 2018/858.

Article 4(2)(a) of Directive 2000/53/EC on end-of-life vehicles prohibits the use of lead, mercury, cadmium or hexavalent chromium in materials and components of vehicles put on the market after 1 July 2003, other than in cases listed in Annex II to that Directive and under the conditions specified therein. Pursuant to Article 4(2)(b) of Directive 2000/53/EC, Annex II to that Directive shall be adapted to scientific and technical progress by the Commission on a regular basis. This adaptation is done through the draft Directive.

The draft Directive adapts to scientific and technical progress the list of materials and components, which are exempt from the prohibition of the use of hexavalent chromiumin materials, and components of vehicles put on the market after 1 July 2003. This draft Commission Implementing Regulation provides that the approval of the active substance metalaxyl-M is renewed in accordance with Regulation (EC) No 1107/2009, subject to certain restrictions including to the use of seeds treated with product containing metalaxyl-M. Use as seed treatment is permitted, however, treated seeds shall only be sown in greenhouses. Other uses e.g. foliar spraying can still be authorised by EU Member States.

Existing authorised plant protection products containing metalaxyl-M will be reviewed in accordance with the proposed restrictions. The renewal of approval is based on the first evaluation of the substance for use as a pesticide active substance in the EU under Regulation (EC) No 1107/2009. The substance was formerly approved under Directive 91/414/ EEC.

This decision only concerns the placing on the market and use of metalaxyl-M and plant protection products containing it. The decision does not affect existing Maximum Reside Levels (MRLs).
Environment related objective
Protection of human health or safety; protection of animal or plant life or health; protection of the environment. In order for an active substance to be approved in accordance with Regulation (EC) No 1107/2009 (concerning the placing of plant protection products on the market), it must be demonstrated that the substance is not harmful to human health, animal health or the environment. Criteria are listed in Article 4 of the Regulation (and also detailed in Annex II) which must be met to enable approval. During the evaluation and peer-review of metalaxyl-M, a number of concerns were identified. These are detailed in the conclusion of the European Food Safety Authority (EFSA) . EFSA concluded that based on the information available, the genotoxic potential of one impurity (2-[(2,6-dimethyl-phenyl)-(2-methoxyacetyl)-amino]-propionic acid 1-methoxycarbonyl-ethyl ester) in the technical active substance as manufactured could not be ruled out. However, the evaluation showed that if the impurity is present below a certain level (0.18 g/kg) that a concern does not exist. Furthermore, two other impurities (2,6-dimethylphenylamine and 4-methoxy-5-methyl-5H-[1,2]oxathiole 2,2-dioxide) are considered toxicologically relevant. It is therefore necessary to establish maximum levels for those three impurities in the technical active substance as manufactured. EFSA also identified a high risk to birds and mammals from the use of metalaxyl-m as a seed treatment. In order to address this concern, seeds treated with metalaxyl-M shall only be sown in greenhouses. The risk from consumption of seedlings was considered acceptable for the two representative crops considered (sunflowers and spinach) . For the use on spinach, residue data allow to conclude that seedlings can be planted in the field after 21 days. For other crops, such data are not available. EU Member States therefore need to pay particular attention to the period before seedlings can be planted in open fields. Existing authorisations will need to be amended or withdrawn following renewal of authorisation in accordance with Article 43 of Regulation (EC) No 1107/2009.

The draft Implementing Regulation (IR) provides clarifications regarding the duties of registrants pertaining to updates of their registration dossier in line with Article 22 of REACH. The REACH review[1] identified that incentives are lacking for companies to update their registration dossiers and work is still needed to rectify important data gaps or inappropriate adaptations to testing. This conclusion is based on more than 10 years of dossier evaluation work carried out by ECHA. Article 22 of REACH states that updates should be undertaken 'without undue delay' in the cases provided in Article 22(1)(a)-(i) .This wording has proven to be difficult to enforce. Therefore, this IR specifies explicit timeframes for updates in the individual cases listed in Article 22(1)(a)-(i) . The IR does not affect other provisions in REACH that require updates in specific situations. For reasons of legal clarity and practical enforceability, the IR identifies only two timeframes: updates to be done within 3 months and within 6 months.
