Draft Commission Delegated Regulation amending Annex II to Delegated Regulation (EU) No 1062/2014 on the work programme for the systematic examination of all existing active substances contained in biocidal products referred to in Regulation (EU) No 528/2012 of the European Parliament and of the Council

This draft Commission Implementing Regulation provides that the approval of the active substance propiconazole is not renewed in accordance with Regulation (EC) No 1107/2009. Existing authorised plant protection products containing propiconazole will be withdrawn from the market. The non-approval is based on the first evaluation of the substance for use as a pesticide active substance in the EU under Regulation (EC) No 1107/2009. The substance was formerly approved under Directive 91/414/ EEC.

This decision only concerns the placing on the market of this substance and does not affect the Maximum Residue Levels (MRLs) for residues of the concerned pesticide. However, following non-approval, separate action may be taken on MRLs. Any subsequent action on MRLs will be subject to notification under the SPS procedure.

The notified Order provides for the mandatory implementation of two standards: This measure constitutes an exemption from the marketing authorization referred to in Article L255-2 of the Rural and Maritime Fisheries Code, and set out in Article L 255-5.

Standard NF U 44-001 - Basic mineral soil conditioners - Designations and specifications, sets out the designations, specifications and marking of basic mineral soil conditioners. It is compliant with the regulatory framework laid down by the regulations in force. It is aimed particularly at producers, users and official inspection bodies. This standard replaces the 2009 standard.

The draft regulations make amendments to national approval schemes for Small-series type approval and Individual approval, which were set up in 2009 as foreseen under Article 23 and 24 of Directive 2007/46/EC on road vehicle approval. The national approval schemes offer manufacturers who sell low volumes of vehicles and sell them only into the UK, an alternative to obtaining European Whole Vehicle Type Approval (ECWVTA) . The regulations include provisions for accepting national approvals from other member states, in line with Articles 23-6, 23-7 and 24-6 of the Directive which specify the Mutual Recognition procedures which must be followed. The technical standards for the national approval schemes have been updated to cover the latest EU regulations on Emissions and Safety, and are closely based on the requirements in the relevant EC Directives.

In addition we are proposing an amendment to passenger car fuel consumption regulations, in order to implement Commission Recommendation of 31.5.2017 on the use of fuel consumption and CO2 emission values type-approved and measured in accordance with the World Harmonised Light Vehicles Test Procedure (WLTP) when making information available for consumers pursuant to Directive 1999/94/EC of the European Parliament and of the Council around the introduction of WLTP testing.
