This draft Regulation would amend entry 63 to Annex XVII to Regulation (EC) No 1907/2006.

It would prohibit the use of lead and lead compounds in articles produced from polymers or copolymers of vinyl chloride as well as their placing on the market in articles produced from PVC if the concentration of lead (expressed as metal) is equal to or greater than 0.1% by weight of the PVC material. Time-limited exemptions from this limit are provided for rigid and flexible recycled PVC material and for PVC-silica separators in lead acid batteries.

Protection of environment by reducing releases of lead during the service life of PVC articles thereby contributing to reducing direct and indirect exposure to lead, a toxic metal.

This draft Regulation would amend entry 63 to Annex XVII to Regulation (EC) No 1907/2006.

It would prohibit the use of lead and lead compounds in articles produced from polymers or copolymers of vinyl chloride as well as their placing on the market in articles produced from PVC if the concentration of lead (expressed as metal) is equal to or greater than 0.1% by weight of the PVC material. Time-limited exemptions from this limit are provided for rigid and flexible recycled PVC material and for PVC-silica separators in lead acid batteries.

According to Article 45(1) of the CLP Regulation, Member States' appointed bodies shall receive information from importers and downstream users on the hazardous chemical mixtures they place on the market. Commission Regulation (EU) No 2017/542 amended the CLP Regulation by adding an Annex harmonising the information to be provided relating to emergency health response ("Annex VIII") . Annex VIII was adopted in March 2017 and will become applicable on 1 January 2020. The Commission is proposing an amendment to Annex VIII before its applicability date that would contain uncontentious clarifications of the text, so as to streamline interpretation, improve internal coherence, and mitigate some unintended consequences made apparent only after the adoption of the Annex.

According to Article 45(1) of the CLP Regulation, Member States' appointed bodies shall receive information from importers and downstream users on the hazardous chemical mixtures they place on the market. Commission Regulation (EU) No 2017/542 amended the CLP Regulation by adding an Annex harmonising the information to be provided relating to emergency health response ("Annex VIII") . Annex VIII was adopted in March 2017 and will become applicable on 1 January 2020. The Commission is proposing an amendment to Annex VIII before its applicability date that would contain uncontentious clarifications of the text, so as to streamline interpretation, improve internal coherence, and mitigate some unintended consequences made apparent only after the adoption of the Annex.

Producers need to have legal certainty on the new rules that will apply for these categories of products and EU Member States need to have enough time to integrate these new rules into their national legislations

This draft Commission Implementing Regulation provides that the approval of the active substance thiacloprid is not renewed in accordance with Regulation (EC) No 1107/2009. EU Member States shall withdraw authorisations for plant protection products containing thiacloprid as active substance. The non-renewal of the approval is based on the first evaluation of the substance for use as a pesticide active substance in the EU under Regulation (EC) No 1107/2009. The substance was formerly assessed and approved under Directive 91/414/ EEC.

This decision only concerns the placing on the market of this substance and plant protection products containing it. Following non-renewal of approval and the expiry of all grace periods for stocks of products containing this substance, separate action will likely be taken on MRLs and a separate notification will be made in accordance with SPS procedures.

• Alignment with the Globally Harmonized System of Classification and Labelling of Chemicals (GHS), 6th and 7th revisions, most prominently in Sections 9 (Physical and chemical properties) and 14 (Transport) .

• Alignment with the provisions of Annex VIII (on emergency health response) to Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures (CLP), in particular in relation to the Unique Formula Identifiers (UFIs) assigned to hazardous mixtures, in Section 1 (Identification) .

• Alignment with the new provisions for nanoform substances, adopted on 3 December 2018 through the revision of REACH Annexes I, III, and VI-XII to REACH (Commission Regulation (EU) 2018/1881), in Sections 1 (Identification), 3 (Composition/information on ingredients) and 9 (Physical and chemical properties) .

In addition to the above three main changes, a number of smaller amendments are proposed to the text, related to recent developments in the Commission's approaches to risk management of chemicals, such as on endocrine disruptors.

Application of the amended Annex is deferred to 31 December 2022 to allow stakeholders sufficient time to adapt and achieve compliance.

The enclosed draft implementing act and annexes contain the initiatives to lay down the administrative requirements for certificate templates, information documents, numbering systems, test result sheets and the format of test reports necessary for granting EU and national type approvals under the framework Regulation (EU) 2018/858.

These amendments secure that the type-approval authorities use harmonised templates, markings and presentation of the most relevant test information when granting type-approvals under EU Regulation 2018/858.
Environment related objective
Regulation (EU) No 2018/858 sets out general requirements on the approval and market surveillance of motor vehicles and their trailers (M-, N- and O-category vehicles) and of systems, components and separate technical units intended for such vehicles, amending Regulations (EC) No 715/2007 and (EC) No 595/2009 and repealing Directive 2007/46/EC.

Based on the empowerments in Regulation (EU) 2018/858, the Commission laid down in detail the administrative provisions and templates for the type-approval and market surveillance of M-, N- and O-category vehicles.

Regulation (EU) 2018/858 was published in the EU OJ in June 2018. The administrative requirements for certificate templates, information documents, numbering systems, test result sheets and the format of test reports were not included in the final adopted version of the framework Regulation (EU) 2018/858.

This implementing act of administrative nature is necessary for the regular implementation of Regulation (EU) 2018/858 already well known by the Member States and manufacturers.

Article 4(2)(a) of Directive 2000/53/EC on end-of-life vehicles prohibits the use of lead, mercury, cadmium or hexavalent chromium in materials and components of vehicles put on the market after 1 July 2003, other than in cases listed in Annex II to that Directive and under the conditions specified therein. Pursuant to Article 4(2)(b) of Directive 2000/53/EC, Annex II to that Directive shall be adapted to scientific and technical progress by the Commission on a regular basis. This adaptation is done through the draft Directive.

The draft Directive adapts to scientific and technical progress the list of materials and components, which are exempt from the prohibition of the use of hexavalent chromiumin materials, and components of vehicles put on the market after 1 July 2003.
