Raw cane sugar tariff-rate quota (TRQ) administration - Additional U.S. note 5 to Chapter 17 of the Harmonized Tariff Schedule of the United States (HTS) established by Presidential Proclamation 6763 of December 1994 authorizes the Secretary of Agriculture to establish for each fiscal year the quantity of sugars and syrups that may be entered at the lower tariff rates of tariff-rate quotas. The tariff-rate quotas cover sugars and syrups described in HTS subheadings, 1701.12, 1701.13, 1701.14, 1701.91, 1701.99, 1702.90 and 2106.90. This authority was proclaimed to implement the results of the Uruguay Round of multilateral trade negotiations as reflected in the provisions of Schedule XX (United States), annexed to the Agreement Establishing the World Trade Organization.

Fish and wildlife (including endangered species ) - Endangered Species Act of 1973 (ESA)
As part of that rulemaking and under authority of the Endangered Species Act of 1973 (ESA), an import/export licence is required for any person who engages in business as an importer or exporter of fish or wildlife unless that person imports or exports certain excepted wildlife or falls within one of the categories of persons excepted from the requirement by the rules. The licensing provision was promulgated under section 9(d) of the ESA [16 U.S.C. 1538(d)] which provides that it is illegal for any person to engage in business as an importer or exporter of fish or wildlife (other than certain shellfish or fishery products) without first having obtained permission from the Secretary of the Interior. |

30. Special test of goods: (1) If it is required to subject any goods to a special test from the health or environmental perspective, the Customs Officer may get such goods tested by the concerned body or laboratory. [...] (4) If, in carrying out test pursuant to sub-section (3), the goods appear to cause adverse effects or damage to the environment or health, the Customs Officer shall order the concerned importer to return such goods back to the concerned exporter of the foreign country, in such manner as prescribed. Provided that, prior to making such order, the Customs Officer may ask the importer to submit an evidence showing the refund of foreign currency paid for such goods or a bond covenanting to have refund of such foreign currency. [...] 25 Arrangement to remove or destroy the goods which cannot be used: 1. Chief of the customs office should make written decision giving reasons for the removal or destroying of the goods and also specify the procedure for carrying out the decision in case of following goods: a) [...] b) As per rule (30) of the Act, goods, upon the laboratory test, found to be harmful for health or environment or found to be adversely affecting health or environment , the exporter did not return the goods, despite the instruction issued by the customs officer to return such goods. c) [...] 4. Notwithstanding the provision in the this rule the customs office should follow the instruction in case the destroying of goods or poisonous product or heavy equipment or vehicles adversely affect the people's health or environment. |
