QR No. 1: Asbestos

Exportation of asbestos and goods containing asbestos is prohibited unless the goods are raw materials that contain naturally occurring traces of asbestos, or the asbestos is, or the goods are, hazardous waste as defined in section 4 of the Act, or a confirmation in accordance with sub-regulation (3) has been issued by the relevant State or Territory agency, or permission has been granted by the Minister administering the Work Health and Safety Act 2011 or a person authorised by that Minister.
However, the prohibition does not prohibit the exportation from Australia, of goods, containing asbestos, that are incorporated into other goods in a way that does not constitute a risk to users until the asbestos is disturbed.

QR No. 14: Non-Automatic Export Licensing of All minerals, defined as liquid, solid and gas substances found on surface or beneath surface (excluding water, oil, natural gas and surface earth soil are excluded from this definition).

Export authorization from the Ministry of Mines and Petroleum / Cadastre Department.

Pursuant to Article 104 of the Law, export is subject to holding an Exploitation Licence, Small-Scale Mining Licence or Artisanal Mining Licence. For the sale or export of restricted minerals, a special authorization may be required.
All minerals, defined as liquid, solid and gas substances found on surface or beneath surface (excluding water, oil, natural gas and surface earth soil are excluded from this definition)

Any of the following fibrous forms of mineral silicates belonging to the serpentine or amphibole groups of rock-forming minerals:

(a) actinolite asbestos;
(b) amosite (brown asbestos);
(c) anthophyllite asbestos;
(d) chrysotile (white asbestos);
(e) crocidolite (blue asbestos);
(f) tremolite asbestos.

(Actinolite, amosite, anthophyllite, crocidolite and tremolite asbestos are also under the coverage of the Rotterdam Convention)
Type of measure
Import licences

Under the PI Regulations 1956, the import of asbestos, or goods containing asbestos, is prohibited unless:
(a) The asbestos or goods are hazardous waste as defined in Section 4 of the Hazardous Waste (Regulation of Exports and Imports) Ac; (b) The goods are raw materials containing naturally occurring traces of amphibole asbestos; or
(c) Permission has been granted by the Minister administering the Work Health and Safety Act 2011, to import chrysotile asbestos for research, analysis or display, or to import amphibole asbestos; or
(d) The asbestos or goods are imported from the Australian Antarctic Territory (chrysotile only); or
(e) The import is of a ship or resources installation that contains in situ amphibole asbestos or chrysotile (installed or affixed before 1 January 2005).
