THE MODIFICATION OF THE TIMETABLE FOR THE DISMANTLING OF THE BALANCE-OF-PAYMENTS SAFEGUARD MEASURE IMPOSED BY THE REPUBLIC OF ECUADOR

In line with article 389 of the Constitution of the Republic of Ecuador, which provides that the State shall protect persons, communities and nature against the adverse effects of natural or manmade disasters through risk prevention, disaster mitigation, restoration and the improvement of social, economic and environmental conditions, with a view to minimizing the condition of vulnerability, Ecuador notifies the WTO for the modifications in time schedules, for removing the 5% surcharge and for deferring for an additional year the implementation of the rest of the timetable proposed and discussed in the Committee, so that the reduction of the existing surcharges by one third will take effect in April 2017, and so on and so forth until the measure is completely eliminated in June 2017.

The National Trade Remedies Authority (ANMCC) has not yet proposed any measure to follow up on the finding of serious injury or threat thereof. It is currently studying the recommendations to be made regarding the appropriate measures to be notified subsequently.

Unforeseen Developments
The sudden, recent, significant and sharp increase in imports of lubricant oils that are the subject of the investigation is due to unforeseen developments, in particular the energy transition of developed countries, including some countries or economic unions that have adopted energy transition policies and strategies since 2015. The aim of this transition is to reduce environmental pollution and promote the use of renewable energy sources, encouraging the use of biodegradable oils known as biolubricants. Consequently, developing countries have become the main destinations for mineral oil lubricants on account of the absence of energy transition policies or delays in their adoption.

Decision to extend a safeguard measure that is being applied against imports of Polyethylene terephthalate (PET) and non-application of the safeguard measure to developing countries.
- It is expected that the domestic producers perform production in compliance with the legal rules, and in this respect, use recyclable packing materials (RPET) only.
- A firm has carried out a study process at the beginning of the year 2013 to produce the products that have high profit potential and a special intended use, and are mainly considered as export material, however, can be also used in domestic market. As the result of that, this firm has produced PET-resin chips that provides energy saving for user during the preform swelling process and contains re-heat material.
- A firm put the solid waste recycle system into use in September of 2011. Through this system, solid waste s that occur during the production are processed, and afterwards, can be used in the production process again. This process is in progress and a saving in the amount of 200.000 euro per year is expected from it.

State Environmental Investment Agency of Ukraine

After reviewing the information from the State Environmental Investment Agency of Ukraine, Ministry of Economic Development and Trade of Ukraine and position of domestic producers the Commission has established the following:
• non-application of special measures concerning import into Ukraine of certain types of cars with hybrid propulsion will not have negative impact on the domestic producers;
• Ukraine's national interests require non-application of special measures concerning import into Ukraine of certain types of cars with hybrid propulsion.

1) Machinery
The Applicant has done the modernization by replacing old machines with new machines that aims to:

3. 4. Adding the production facilities such as research laboratory for materials, Non-Destructive Test machine, and Sand Blasting facilities that are environmentally friendly.

This supplement accurately specifies the duration of the safegard measure which will be in force for a period of 2 years as indicated below:

(a) 25% ad valorem minus anti-dumping duty payable, if any, when imported during the period from 30 July, 2018 to 29 July, 2019 (both days inclusive);
(b) 20% ad valorem minus anti-dumping duty payable, if any, when imported during the period from 30 July, 2019 to 29 January, 2020 (both days inclusive); and
(c) 15% ad valorem minus anti-dumping duty payable, if any, when imported during the period from 30 January, 2020 to 29 July, 2020 (both days inclusive).
